22 April 03: Market Analysis to assist Freeserve.com in BT predation case

Market Analysis has been retained by Freeserve.com to provide expert economic support in its predatory pricing complaint against British Telecom in the residential broadband market. The Competition Appeals Tribunal ordered the telecom’s regulator Oftel to reconsider the case on 16 April, following Freeserve’s appeal against Oftel’s rejection of its predatory pricing complaint of 26 March 2002. Freeserve’s complaint alleged that BT was conducting ‘an orchestrated campaign of anti-competitive behaviour, aimed at achieving dominance by the incumbent in the market for retail broadband (ADSL) services,’ in breach of the Chapter II prohibition of the Competition Act. Oftel now has until mid-October 2003 to reconsider the case.
