8 August 04: Market Analysis retained by Hutchison 3G to assist in appeal against Ofcom's finding of significant market power in call termination
Market Analysis has been retained by Hutchison 3G UK Ltd (H3G) to provide expert economic evidence in its appeal before the Competition Appeals Tribunal against Ofcom's finding that it has significant market power (SMP) in call termination on its mobile network. H3G believes that Ofcom's decision, as set out in Ofcom's 1st June statement "Wholesale Mobile Voice Call Termination," failed to assess its position against the criteria required by the applicable European Commission's guidelines and recommendations. In particular, Ofcom failed to recognise the extent of countervailing bargaining power exercised by BT and other purchasers of wholesale mobile voice call termination services from H3G, and could find no evidence that H3G would be able to charge excessive prices over the period of Ofcom's review.
